General Release of Liability:  I understand there are risks of physical injury when participating in sports and recreational activities or programs.  I further understand that the Town of New Windsor (hereinafter “the Town”) does not maintain or obtain insurance for those who choose to participate in sporting and recreational activities and programs it runs and/or sponsors, which may provide me with insurance coverage in the event I should be injured while I participate, or my child participates, in any such activity or program.

Notwithstanding the above, I am signing this General Release of Liability (hereinafter “Release”) because I wish to participate, or I wish to allow my child to participate, in the applicable town-sponsored sports and recreational activity or program, with the knowledge and understanding that, in doing so, I hereby agree to forever release, indemnify and hold harmless the Town of New Windsor, its Town Board, its Recreation & Parks Department, and all employees, volunteers, officials and agents of the Town, from any and all responsibility, liability, loss or damage for any and all injury, including, but not limited to physical injury, emotional injury, and injury to personal property, which my child or I may experience in connection with the activity or program for which this Release is provided. 

I further understand and agree that this General Release shall be binding on anyone that may seek to myself, my children, my beneficiaries, heirs, executors and administrators

I further consent to allow all emergency medical procedures deemed advisable by emergency medical providers and/or first responders be taken for me or my child in the event I am unable to consent on my own at the time such procedures are provided or cannot be reached after my child has sustained an injury.

I further certify that I/my child does not have any medical condition that would make it dangerous for me/my child to participate in the activity or program for which this General Release is provided.

By signing this General Release, I understand and acknowledge that neither the Town nor the Town’s Recreation and Parks Dept. provide accident or hospitalization insurance for participants of its programs and, in participating myself or in allowing by child to participate, I have been advised it is my responsibility to ensure I have adequate personal insurance coverage of my own, and have taken into consideration my own and/or my child’s own health conditions, experience, and tolerance for risk before participating in any sports and recreational activity or program sponsored the Town.  

I also understand that the Town and/or Recreation & Parks Dept. may use photos, video, artwork, etc. of me and/or my child for publicity, via social media and/or printed materials, unless I notify them, in writing, of my objections to same. 

I further understand and agree that the Town or the Recreation & Parks Dept. may cancel the activity or program, for which this General Release is provided, for any reason it deems appropriate, including, but not limited to insufficient participation, insufficient staffing, weather, etc.; and if canceled, a full refund shall be issued and nothing more. 

If a participant becomes ill or injured and is unable to attend or participate in the activity or program for which this General Release is provided, a prorated refund (less any applicable processing fees, which the Town is unable to recover) will be issued upon the Town’s receipt of a signed doctor’s note, which must corroborate the illness or injury claimed to preclude the participant’s participation.  Said doctor’s note must be provided to the Town or to the Recreation & Parks Dept. within thirty (30) days of the precipitating illness or injury.   There will be no refund if a participant begins the activity or program and is picked up early, for whatever reason, or is asked to leave due to a disciplinary issue, or due to the discovery of misrepresentation(s) made in order to participate. 

All activity and program dates are subject to change.  No refunds will be given if a new date cannot be made or attended by the participant.


TOWN OF NEW WINDSOR FIELD / FACILITY USE REQUIREMENTS
The use of all Recreation and Park facilities shall be subject to the approval and rules of the
Recreation Department, as administered by the Director of Recreation.
1. ANY AND ALL EVENTS SPONSORED BY THE TOWN OF NEW WINDSOR
SHALL HAVE PRIORITY IN SCHEDULING OVER OTHER NON-TOWN
SPONSORED EVENTS.
2. Organizations wishing to use municipal facilities shall first apply to the Recreation Department on the prescribed form. The Recreation Director or her designee has final authority on
approval.
3. In the event of inclement weather, electrical storms or other conflicts, the Director or her
designee has the final authority on the use of the field(s). Cancellations or delays will be
rescheduled at the discretion of the Director.
4. Possession of alcoholic beverages or controlled substances is strictly prohibited and
cause for ejection and/or further prosecution. The private sale of any food and/or
beverage is strictly prohibited.
5. All posted rules must be adhered to. No person shall perform any act which produces
unreasonably intrusive sound or noise.
6. Profanity, objectionable language, disorderly acts or illegal activities of any kind are
absolutely prohibited, and those violating this prohibition will be ejected from the premises.
7. Any damage to municipal facilities shall be promptly repaired at the user's expense. No
exceptions. If maintenance personnel are not available, make sure all doors are locked and
lights are turned out when leaving.
8. Organizations using the facilities must clean-up afterwards. The Recreation Department
reserves the right to require a clean-up bond.
9. Permittee must have possession of permit at time of use. Permits may be revoked at any
time. Permits are non-transferable.
10. Any event or use of the Town’s fields or facilities by children under 18 years old requires the presence of adequate adult supervision at all times.
11. The fee for use is: in accordance with the fee scheduled annexed hereto. NO
PERMIT WILL BE ISSUED UNTIL ALL FEES ARE PAID.
12. Cancellation/Refund Policy: Single game/practice rentals require at least 24-hour notice for cancellation unless due to inclement weather. Tournament rentals require six (6) weeks’
notice for cancellation. Credit will be granted for cancellations ONLY if proper notice has
been given or if due to inclement weather, and shall always be subject to the discretion of the Recreation Director.
13. In the event of an accident or emergency, both the Town of New Windsor Police Department (845-565-7000) and the Recreation Department must be advised immediately (845-565-7750).
